    In most cases in most state age discrimination is perfectly legal. When I was in my mid 50’s i decided to go back to work. After filling out about 100 applications and not getting a response I decided to go to truck driving school because the media kept saying there was such a shortage. The first school I went to told me they wouldn’t take my money because there was no way anyone would ever hire me. Fortunately there are companies out there that are willing to give anyone a chance regardless of how many boxes you check. They are just really hard to find

    The law is so broken. You can be defamed but not het justice if they have privilege, fall under an opinion vs. fact, etc. Something isn't right. Who the hell thinks making these laws help anyone ?

    Most managers are thin skinned, and are egotist, last place I worked at I had 12 managers in 8 years, also were 5 different HR managers in that time.

    Fellow employee hurt his back on the job then reported it..two weeks later the "employer" "let him go" and said he couldn't afford to pay him any more. It was just the tip of the iceberg with this "employer".

    Yeah, good luck proving that though. Although I may have been handed the evidence during my unemployment hearing. 😏 I contracted a very tenacious case of bronchitis, and my lungs were having were still having problems. I took a legal LOA granted by HR. I was being treated, but I was denied short term disability due to lack of information. And doctors made them turn the heat up because cold air was a trigger for my issue.

    I remember in Colorado a Lieutenant Broderick who was fired while covering up a murder case. He just happened to be the head of Internal Affairs. An early warning system as you call it.

    Your employer was never your friend or family. We need to have realistic expectations of what an employer will do, understanding it's a negotiation and both sides need to get something. Getting the government & lawyers involved in a dispute with your employer is rarely going to be fun or profitable if one side just doesn't want to play anymore. If your value to your employer is high enough, they'll be willing to be "reasonable".

    Just letting people know I called EEOC in New York you can file Multiple EEOC in your life time and you are allowed. Being an immigrant is not easy now at work it is very toxic!

    I commented about my experience of 3rd part investigators. Our 3rd party investigators just happened to be ex employees of HR lol also one of my coworkers claim was wild. One of 3rd party investigators was in the building and claimed my coworker sexually harassed them, and then they investigated him and found him guilty. Sounds like a conflict of interest lol getting paid millions of dollars and then creating cases out of thin air

    I work in California for the legislature, and we are at will. Back in 2019 they introduced the Workplace Conduct Unit where you could report others. There was a lot of drama at that time in my particular office (a large one). And by the end of it almost half of the 50+ people was being investigated. There were groups of people who were vocal about making claims just to get others fired, like Survivor. I was a victim of that. My personal case was an allegation of sexual comments. Since I had started working there I was victim of racism, homophobia, and classist remarks. I expressed all of that to the WCU/HR, and they didn't listen. They did however rule that I "more than likely" did what I was accused of. They didn't take days no pay like they did with other, so I thought I was off the hook. I expressed my disappoint in them, because WCU WAS created to help victims and not create more. (Which I felt I was, because I was wrongly accused and found guilty) 2 years later when it's time for merit, they told me because I had a case in the past I wasn't eligible. (Although people who were found guilty before and received x days no pay have received their merit) Also in that time promotion/position opportunities were available and I wasn't able to apply because of my unclean personnel record. I've been here for 6 years and people who have been there less than 2 years make more than me lol I feel like they're punishing me for being vocal about my personal experience of experiencing discrimination and how they didn't help me.

    I work in a logistics warehouse,we use a lot of heavy duty industrial equipment. Ive been here 9 years. About a year ago they put in a speaker system and you cant hear anything. What can i do.

    Ironically, healthcare is horrible with this. I've been fired so many times for things like being unable to multitask because of my ADHD, brain fog from fibromyalgia and Ehlers-Danlos Syndrome, depression, anxiety, and PTSD.

    Yeah, I’m pretty sure this is a safety violation but our two emergency exits lead right into some yards that are fenced up and locked up with only management and loadouts with a key to unlock them and everyone else don’t have the key and I work at a store

    I’ll watch all your videos but wondering the value of damages when you are 4 years from retirement (after already putting in 33 years of service that got high ratings), so if the employer hadn’t been bad, you may have made it the 4 more years. Could you get damages of your salary for those 4 years plus lost 401k savings and growth? I hope not to be terminated due to my retaliatory boss but curious.

      You can get lost wages & benefits + emotional distress damages. These can be very high for someone at the end of their career.

    This video was helpful. But a bit late for me, unfortunately. it five years ago, though. I had some personal struggles and ended up being out on FMLA for four weeks. When I notified my manager of my RTW date, I was asked to come in first to discuss the schedule. For nearly four months I had been getting strong push back and responses that made no sense to me about at least one weekend day off. Well, it wasn't a meeting to discuss my schedule. I was informed that they had been "investigating" me. I was completely shocked. They claimed that it was for "theft" because of how I'd done the payroll. Payroll wasn't even in my job description. I'd been asked to do it to help out, and had done so through three managers. I submitted my work to each of those managers every two weeks so that they could sign off. And they were accusing me? My manager, with whom I had thought we had a good working relationship, sat and glared at me with animosity, her arms crossed, eyeballs rolled, and "pfffts" now and then as if what I was saying wasn't true. At the end of that "meeting" (which happened at HR, after the electronic lock on our office door had been changed--supposedly because it just happened to have been broken), I asked for a mediation. Something had happened. I couldn't make any sense of what had just happened and the odd change in my manager's behavior. I was told by HR "we can't do that". I was put on unpaid leave while they "investigated". I was finally called back after three weeks and told that I had enough PTO to last until my 55th birthday. I could choose to retire and use the PTO or I could be fired. It was my choice. For years before this we'd all heard of old-timers suddenly being let go. I had been there 30 yrears 9 months. Quite a few years before that the company had stopped offering pension to new employees, but for the old-timers it was still a part of our benefits. The starting rate for my position was about 1/2 of my current pay. It wasn't until after I left and I was obsessed with trying to figure out what had happened that I thought about my pension and pay--and a lot of odd things that had been done and said for the previous few months make a little more sense. Since then I have heard of more people at that company experiencing similar things. Always it is an old-timer or someone in a leadership role (ie: higer pay). In fact, the HR rep brought it up during the first meeting. I was so stunned it just didn't make sense, but now I believe it was because they were trying to somehow prove that this wasn't that same type of situation. I still don't really know. I could never afford to bring legal action again this very large system, but I have often wondered if all of us with similar experiences would be able to bring a class action suit. At this point, it's not something I would do. I've moved on and am working for a competing system where the work environment makes me realize how toxic the work environment at my previous job was. I don't live in California, so I won't call for a consult; but if you are able to answer me here about whether or not this is a common HR tactic, I would greatly appreciate it. p.s. my entire three decades of experience with that first employer check the boxes of so many of your points.

    If I'm in an at will state, why do companies have an employee handbook if they can term you for any reason/no reason at all?? When do they follow the handbook ? And if the handbook states it doesn't create a contract between you and the employer , why have one ??

    Always felt this in my bones in my work-life. Glad to have it confirmed. My advice: treat work as nothing more than work. Document everything, with witnesses, cc all the relevant people about everything. Don't look for interpersonal relationships. Don't get too close to anyone, just try to be polite and cool in every situation.

    I Got Fired From Walmart After Asking For A Work Accommodation For An Injury I Had Prior Working For Them & Also Complaining About A Supervisors Behavior Far As Using Profanity & Being Physical With Other Employees..So He's Says Let's Go To My Office & In My Mind, I'm Think He's Going To Give Me Paperwork For A Formal Complaint & Also To Discuss Reasonable Work Accommodations & Then Outta Nowhere, He Says My Performance Is Bad & I'm Fired. Soo It's Almost An Hour Into My Shift & He's Seen Me Multiple Times & Had Plenty Of Chances To Pull Me In His Office To Discuss My "Performance" But Only Did So After Me Speaking To Him First About My Work Needs...I Could Be Wrong But I Definitely Feel Like I Was Wrongfully Terminated Smh

    My wife was leaving her toxic workplace for a new job in a different company. On her LAST DAY they had a recruiter reach out to her that there might be a new opportunity for her to transition to, but it would take a week and asked if she wanted to USE HER PTO for a WEEK to wait out this “up in the air” job to stay in the system for an easier transition when she gets the role. I saw a mile away that they were tryna squeeze my spouse from paying out her leftover PTO for a nonexistent job. Me and my spouse argued about this for a whole day until she caved and told them she’s interested but will still be leaving the company. They still gave her an interview for the role but ultimately gave the job to someone else internally. Companies will promise you the world if you believe in their bs enough. I know my spouse would be kicking herself rn if she stayed and used her PTO for a company that doesn’t give af about her
